Real arguments have six parts, and the one that decides most disputes — the warrant — is almost always left unstated.
1The problem it solves
Formal logic represents arguments as premises and a conclusion, which is accurate for mathematics and nearly useless for everything else. Toulmin's complaint was that this apparatus cannot represent the arguments people actually make in law, policy, or science, and so cannot diagnose why they fail. He built a model that can.
2The idea
The six parts: the claim you are advancing; the grounds — the data or facts you offer; the warrant, a general principle licensing the step from grounds to claim; the backing that supports the warrant itself; a qualifier indicating strength ('probably', 'in most cases'); and the rebuttal conditions under which the claim would not hold.
The warrant is the load-bearing element and it is nearly always implicit, because stating it feels pedantic to the person making the argument. It is also, nine times out of ten, exactly where the disagreement lives. Two people can accept the same data, accept each other's competence, and still disagree completely — because they hold different warrants and neither has said so.
Diagramming a stuck argument this way converts it from a contest into a question. Once the warrant is on the table, you can ask what backs it, and that is a discussable matter rather than a clash of conclusions.
3Origin & context
Stephen Toulmin, The Uses of Argument (1958). It was poorly received by logicians, who saw it as a retreat from rigour, and enthusiastically adopted by rhetoric, law, and later AI and argumentation theory. Toulmin's own background was in the philosophy of science, and the model grew out of asking how jurisprudence reasons — which is why it fits regulatory argument so well.
4Canonical example
Grounds: unemployment rose. Claim: the policy failed. Warrant: unemployment is the right measure of this policy's success. Nobody stated the warrant, and it is the only thing in dispute.
5Objections & replies
Objection. It is a description of argument, not a standard for evaluating one. It tells you the parts, not which arguments are good.
Reply. Fair, and Toulmin partly intended this — he thought standards of soundness were field-dependent, varying between law, medicine, and physics. Critics reasonably reply that this makes the model a taxonomy rather than a logic.
Objection. Warrants can be manufactured after the fact to fit any inference, so making them explicit does not constrain anything.
Reply. In practice it constrains a great deal, because a manufactured warrant usually turns out to be one the arguer would not accept in a symmetrical case. Stating it exposes it to that test, which implicit warrants escape.
6Don't confuse it with
Warrant vs. grounds
Grounds are the specific facts of this case. The warrant is the general principle that makes those facts relevant to this conclusion. 'Unemployment rose' is grounds; 'unemployment is the right measure of this policy's success' is the warrant, and only the second is contested.
Warrant vs. backing
The warrant licenses the inferential step. The backing is what supports the warrant itself — statutes, statistical evidence, professional consensus. Disputes often need to go one level deeper than people take them.
7Common mistakes
- Arguing about the grounds when the warrant is the disagreement. This produces the familiar exchange where both sides keep producing more data and neither moves.
- Omitting the qualifier and the rebuttal, which turns a defensible claim into an overclaim that a single counterexample destroys.
8In your work
Diagram any stuck disagreement this way. Nine times out of ten the gap is an unstated warrant rather than the data, and naming it converts an argument into a question.
9Check yourself
“Compliance costs rose 12% after the rule, so the rule was too burdensome.” Diagram it. Where is the real dispute?

Claim: the rule was too burdensome. Grounds: costs rose 12%. Warrant, unstated: a 12% cost increase exceeds the benefit, or cost increases are themselves the measure of burden regardless of benefit. That warrant is the whole argument, and it is doing all the work while nobody examines it. Note also the missing qualifier and rebuttal — no acknowledgement of what else could have raised costs in that period. Attacking the 12% is the obvious move and the wrong one; the number is probably right.

2ایدهٔ اصلی
شش بخش: ادعایی که پیش مینهید؛ شواهد — دادهها یا واقعیتهایی که ارائه میکنید؛ ضمانت، اصلی کلی که گذر از شواهد به ادعا را مجاز میکند؛ پشتوانهای که خودِ ضمانت را تأیید میکند؛ قیدی که قوّت را نشان میدهد («احتمالاً»، «در بیشترِ موارد»)؛ و شرایطِ نقض که در آنها ادعا برقرار نخواهد بود.
ضمانت عنصرِ باربر است و تقریباً همیشه ضمنی میماند، چون بیانِ آن بهنظرِ گویندهٔ استدلال موشکافانه و زائد میرسد. و نُه بار از ده بار، دقیقاً همانجاست که اختلاف زندگی میکند. دو نفر میتوانند یک دادهٔ واحد را بپذیرند، شایستگیِ یکدیگر را بپذیرند و باز کاملاً اختلاف داشته باشند — چون ضمانتهای متفاوتی دارند و هیچیک آن را نگفته است.
نمودارکردنِ یک بحثِ بیفرجام به این شیوه، آن را از رقابت به پرسش بدل میکند. همینکه ضمانت روی میز آمد، میتوانید بپرسید چه چیزی پشتیبانیاش میکند، و این موضوعی قابل بحث است نه برخوردِ دو نتیجه.
3خاستگاه و زمینه
استیون تولمین، کاربردهای استدلال (۱۹۵۸). منطقدانان بد از آن استقبال کردند و آن را عقبنشینی از دقت دانستند، و بلاغت، حقوق و بعدها هوش مصنوعی و نظریهٔ استدلال با شور پذیرفتندش. پیشینهٔ خودِ تولمین در فلسفهٔ علم بود و این مدل از پرسیدنِ اینکه فقه و حقوق چگونه استدلال میکنند بیرون آمد — و به همین دلیل با استدلالِ مقرراتی چنین خوب جور درمیآید.
4مثالِ کلاسیک
شواهد: بیکاری بالا رفت. ادعا: سیاست شکست خورد. ضمانت: بیکاری سنجهٔ درستِ موفقیتِ این سیاست است. کسی ضمانت را نگفت، و تنها همان محلِ نزاع است.
5اعتراضها و پاسخها
اعتراض. این توصیفِ استدلال است نه معیاری برای ارزیابیِ آن. بخشها را میگوید، نه اینکه کدام استدلال خوب است.
پاسخ. منصفانه است، و تولمین تا حدی همین را در نظر داشت — او معیارهای درستی را وابسته به حوزه میدانست که میان حقوق، پزشکی و فیزیک فرق میکند. منتقدان بهدرستی پاسخ میدهند که این مدل را به ردهبندی بدل میکند نه منطق.
اعتراض. ضمانتها را میتوان پس از واقعه ساخت تا با هر استنتاجی جور دربیایند، پس صریحکردنشان چیزی را محدود نمیکند.
پاسخ. در عمل بسیار محدود میکند، چون ضمانتِ ساختگی معمولاً از آب درمیآید که خودِ گوینده آن را در موردی متقارن نمیپذیرد. بیانِ آن، در معرضِ همین آزمون قرارش میدهد، و ضمانتهای ضمنی از این آزمون میگریزند.
6با اینها اشتباه نگیرید
ضمانت در برابر شواهد
شواهد واقعیتهای مشخصِ این مورد است. ضمانت اصلِ کلیای است که آن واقعیتها را به این نتیجه مربوط میکند. «بیکاری بالا رفت» شاهد است؛ «بیکاری سنجهٔ درستِ موفقیتِ این سیاست است» ضمانت است، و تنها دومی محلِ نزاع است.
ضمانت در برابر پشتوانه
ضمانت گامِ استنتاجی را مجاز میکند. پشتوانه آن چیزی است که خودِ ضمانت را تأیید میکند — قوانین، شواهدِ آماری، اجماعِ حرفهای. نزاعها اغلب باید یک لایه عمیقتر از آنچه مردم میبرند بروند.
7خطاهای رایج
- بحث بر سرِ شواهد وقتی اختلاف بر سرِ ضمانت است. نتیجه همان گفتوگوی آشناست که هر دو طرف مدام دادهٔ بیشتری میآورند و هیچکس جابهجا نمیشود.
- حذفِ قید و شرطِ نقض، که ادعایی قابل دفاع را به ادعایی گزاف بدل میکند که یک نمونهٔ نقض ویرانش میکند.
8در کارِ شما
هر اختلافِ بیفرجام را اینگونه نمودار کنید. نُه بار از ده بار، شکاف یک ضمانتِ ناگفته است نه داده، و نامبردنِ آن، نزاع را به پرسش بدل میکند.
9خودآزمایی
«هزینههای انطباق پس از این قاعده ۱۲ درصد بالا رفت، پس قاعده بیش از حد سنگین بود.» نمودارش کنید. نزاعِ واقعی کجاست؟

ادعا: قاعده بیش از حد سنگین بود. شواهد: هزینهها ۱۲ درصد بالا رفت. ضمانتِ ناگفته: افزایشِ ۱۲ درصدیِ هزینه از فایده بیشتر است، یا افزایشِ هزینه صرفنظر از فایده خودْ سنجهٔ سنگینی است. همان ضمانت تمامِ استدلال است و تمامِ کار را میکند در حالی که کسی وارسیاش نمیکند. به نبودِ قید و شرطِ نقض هم توجه کنید — هیچ اشارهای به اینکه در آن دوره چه چیزِ دیگری میتوانست هزینه را بالا ببرد. حمله به عددِ ۱۲ درصد حرکتِ بدیهی و نادرست است؛ آن عدد احتمالاً درست است.
